How Will the 2020 FMCSA Clearinghouse Rules Impact Your Fleet

FMCSA Clearinghouse Rules Will Take Effect January 6, 2020.  Here’s How Employers Can Prepare For This New DOT Regulation.

  • What is the Clearinghouse?

A secure, online database that will give employers and other authorized users real-time information about commercial driver’s license (CDL) and commercial learner’s permit (CLP) holders’ drug and alcohol program violations. This is a 3 years transition to replace current pre-employment background checks for DOT drug and alcohol violations from previous employers within the last 2 years.

  • How will employers use the Clearinghouse?

Beginning January 6, 2020 employers will be required to:

  1. Query the clearinghouse for current and prospective employees’ drug and alcohol violations before permitting those employees to operate a Commercial Motor Vehicle on public roads
  2. Query all current employees annually through the Clearinghouse to check for any drug and alcohol violations

Employers of CDL drivers can now purchase a query plan. Purchasing a query plan enables employers, and their designated consortia/third-party administrators (C/TPAs), to query the Clearinghouse for information on potential and currently employed drivers. All queries require driver consent.

Query plans may be purchased only on the FMCSA Clearinghouse website by registered employers. Visit https://clearinghouse.fmcsa.dot.gov/query/plan to learn more. C/TPAs may not purchase query plans on behalf of an employer.
